Terms of Service

These Terms govern use of Gymsly (the web app, the Gymsly Admin app, and the Gymsly Member app, the "Service") provided by Akstuudio ("Gymsly", "we"). By creating an account or using the Service you agree to these Terms and to our Privacy Policy.

1. The Service

Gymsly lets a gym owner manage members, classes, billing, staff, and communications, and gives that gym's members a self-serve portal. As between a gym and its members, the gym decides what member data to collect and how to use it: the gym is the data controller for that data, and Gymsly processes it on the gym's behalf (see our Data Processing Addendum).

2. Accounts

• You must provide accurate information and keep your login credentials confidential.
• You're responsible for activity under your account, including staff accounts you provision.
• You must have the legal right to collect and process the personal data of your members, leads, and staff that you enter into Gymsly, and to obtain any consents that data requires (for example, marketing opt-in or health-data consent).

3. Subscriptions & billing

Paid plans are billed in advance via Stripe, Razorpay, or Apple In-App Purchase, as applicable. Fees are non-refundable except where required by law. We may suspend access for non-payment after notice.

4. Acceptable use

You agree not to:

• Use the Service to send unsolicited or unlawful marketing communications;
• Upload data you don't have the right to process, or collect special-category data (health, biometric) without the consent the law requires;
• Attempt to access another gym's data, or circumvent access controls;
• Reverse-engineer or resell the Service without our written consent.

5. Your content and data

You retain ownership of the data you and your members enter into Gymsly. You grant us a limited license to host, process, and transmit it solely to provide the Service. You can export your data at any time from Settings, and delete your account and data as described in our Privacy Policy.

6. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate accounts that violate these Terms, don't pay fees due, or pose a security risk. On deletion, we remove your gym's data (including member records) from active systems, subject to reasonable backup retention and legal obligations.

7. Disclaimers & liability

The Service is provided "as is." To the extent permitted by law, Gymsly is not liable for indirect, incidental, or consequential damages, and our total liability is limited to the fees you paid in the 12 months before the claim.

8. Changes

We may update these Terms; continued use after a change means you accept the update.
